Marijuana was illegal in 29 states when this song was written, but there was no federal ban on it. After the national marijuana prohibition in 1937, Federal Bureau of Narcotics commissioner Harry Anslinger learned that, however, a certain group of people were flagrantly violating the law by continuing to smoke pot.
